Emergi Liberia Terms & Conditions

These General Terms and Conditions set out the terms and conditions applying to and governing the usage of the Emergi Passenger App ("the App") which connects passengers with our fleet of drivers to help them move around cities sustainably. By using our services, you agree to comply with and be bound by the following terms and conditions. Please read them carefully. The Emergi Passenger App has been developed by Emergi B.V., the Netherlands as a commercial app and has been leased to Emergi Liberia Incorporated to provide app ride-hailing and related services. 

1. Definitions

"App" refers to the Emergi Passenger App

"User" refers to any person who uses the App.

"Driver" refers to female drivers providing transportation services through the App.

"eTuktuks" refers to electric three-wheeled vehicles available for transportation services.

2. User Eligibility

By using the App, you represent and warrant that you are at least 18 years old and capable of entering into a legally binding agreement.

3. Service Description

The Emergi Passenger App provides a platform that connects Users with female drivers operating electric Tuktuks for transportation services in Liberia.

4. Booking and Payment

Users may book rides through the App or through design experiments on the Landing Page. Users agree to pay the specified fare for each ride using the payment methods offered by the Driver

5. Safety and Security

The Emergi Passenger App prioritizes the safety of its Users and Drivers.

Users must treat Drivers with respect and refrain from engaging in any harmful or inappropriate behavior.

Drivers undergo thorough extensive training and a screening process before joining Emergi’s fleet.

6. Cancellation and Refund Policy

Users may cancel a booked ride, but cancellation fees may apply. 

7. Code of Conduct

Users must adhere to a code of conduct that promotes respectful and safe interactions. This code of conduct includes:

  • Treating the driver in a respectful manner
  • Being calm in unexpected situations
  • Respecting the driver’s right to privacy
  • Not littering or damaging the e-Tuktuk or e-Kekeh or Electric Auto Rickshaw during the ride
  • Completing the payment for services by the driver

Any violation of a standard code of conduct may result in the suspension or termination of the User's account.

8. Intellectual Property

The App and its content are protected by intellectual property laws. Users may not reproduce, distribute, or create derivative works.

9. Limitation of Liability

Emergi Liberia and Emergi B.V are not liable for any damages, including but not limited to, direct, indirect, incidental, consequential, or punitive damages arising out of the use of the App.

10. Governing Law and Dispute Resolution

These terms are governed by the laws of Liberia. Any disputes arising from the use of the App shall be resolved through arbitration in accordance to local practices.

11. Changes to Terms and Conditions

Emergi Liberia and Emergi B.V reserve the right to modify these terms at any time. Thus, you are advised to review this page periodically for any changes. We will notify you of any changes by posting the new Privacy Policy on this page or by email if you have agreed to receive updates from the Emergi Passenger App during sign-up.

By using the Emergi Passenger App, you acknowledge that you have read, understood, and agreed to these Terms and Conditions.
